I think what Luis is referring to is the classification of use as "commercial" if, for example, you get paid a salary. And presumably, most of us do get paid for the work we do, and for which we'd use Andy's data, whether it came from a subscription directly, or indirectly through Bennett and Simon's challenge dataset.

This very classification is used, I seem to recall, by Intel for their compilers, which you may not use under the "non-commercial license" for your work, even if your employer is a non-profit. So this isn't a merely philosophical argument.

To refer to the wording from the CC license that you quoted - the salaray you receive would indeed be "private monetary compensation", and thus be excluded by the "NC"-type license. Don't you think?
